Terms of Service
Effective Date: May 2nd 2025
These Terms of Service (“Terms”) govern your access to and use of JobWeb, located at https://jobweb.io, including the JobWeb job board, Fitcheck, alerts, recommendations, job-scoring tools, email-processing features, account features, and related websites, applications, products, and services (collectively, the “Service”). Fitcheck is part of JobWeb and is covered by these Terms.
The Service is operated by JobWeb.io (“Company,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to both you and that entity.
2. Description of the Service
JobWeb provides tools related to job discovery, job listings, job matching, job scoring, job research, application links, and related workflow assistance.
Fitcheck may help users evaluate job opportunities against user-provided preferences, criteria, resumes, profiles, search settings, compensation preferences, location preferences, title preferences, and other job-search signals.
The Service may include automated tools, artificial intelligence, machine learning, search, crawling, extraction, summarization, classification, scoring, ranking, alerts, and recommendations.
The Service is provided for informational and organizational purposes only. We do not guarantee any specific job-search, hiring, recruiting, employment, compensation, or business outcome.
3. No Employment, Recruiting, or Agency Relationship
Unless expressly stated in a separate written agreement, JobWeb is not an employer, recruiter, staffing agency, hiring agency, background-check provider, employment agency, or agent of any employer or candidate.
We do not make hiring decisions, employment decisions, compensation decisions, interview decisions, or candidate-selection decisions on behalf of employers.
Use of the Service does not create an employment, contractor, agency, fiduciary, partnership, joint venture, or franchise relationship between you and JobWeb.
4. Job Listings and Job Information
The Service may display, summarize, classify, rank, score, or link to job listings, employer pages, career sites, applicant tracking systems, job boards, public postings, and third-party sources.
Job listings and related information may be provided by third parties, collected from public sources, extracted from websites, submitted by users, generated by automated systems, or derived from other available information.
We do not guarantee that any job listing, company profile, compensation range, location, remote-work status, title, department, employment type, application link, hiring status, qualification, benefit, or other job-related information is accurate, complete, current, lawful, available, or suitable for you.
Job listings may expire, change, be removed, become unavailable, contain errors, or differ from the information shown on the employer’s official website or applicant tracking system.
You are responsible for verifying all job details directly with the employer, recruiter, or official application site before applying, interviewing, accepting an offer, or making any employment-related decision.
5. Third-Party Sites, Employers, and Applicant Tracking Systems
The Service may link to or interact with third-party websites and services, including employer websites, career pages, applicant tracking systems, job boards, identity providers, email providers, payment processors, analytics providers, and other vendors.
Third-party sites and services are not controlled by us. We are not responsible for their content, availability, accuracy, policies, privacy practices, security, fees, communications, hiring decisions, or actions.
When you visit, apply through, sign in to, or otherwise use a third-party site or service, your activity is governed by that third party’s terms, privacy policy, and other rules.
We are not responsible for any loss, claim, dispute, rejection, missed opportunity, application issue, account issue, data issue, or other harm arising from your use of third-party sites or services.
6. Fitcheck, Scoring, Recommendations, and AI Outputs
Fitcheck and related features may use automated systems to extract, classify, summarize, compare, score, rank, or recommend job opportunities based on available job information and user-provided criteria.
Automated outputs may be incomplete, inaccurate, outdated, biased, inconsistent, or based on limited information. The Service may misunderstand job postings, compensation, titles, seniority, locations, remote-work policies, qualifications, employer requirements, or your preferences.
Scores, rankings, recommendations, summaries, alerts, labels, classifications, and other outputs are not professional advice and should not be treated as definitive.
You are responsible for independently reviewing job opportunities and deciding whether to apply, interview, accept, reject, or pursue any opportunity.
We do not guarantee that Fitcheck or any automated feature will identify all relevant jobs, exclude all irrelevant jobs, correctly interpret your preferences, or improve your job-search results.
7. Email and Account-Connected Features
The Service may allow you to connect third-party accounts, including email accounts such as Gmail, Outlook, Microsoft, or other providers, to help identify, parse, organize, score, or summarize job opportunities and job-related messages.
By connecting an account, you authorize us to access, process, store, and use information from that account as necessary to provide the Service, subject to the permissions you grant and our Privacy Policy.
We may process message metadata, sender information, subject lines, message bodies, links, job listings, attachments, and related content where permitted by your account connection and settings.
You are responsible for ensuring that you have the right to connect any account and provide any related content to the Service.
You may revoke connected-account access through your account settings, the third-party provider’s settings, or other available controls. Revoking access may limit or disable some Service features.
We do not guarantee that email parsing, job detection, extraction, deduplication, scoring, or alerting will be complete, accurate, timely, or error-free.
8. User Content
The Service may allow you to submit, upload, transmit, import, connect, or otherwise provide content, data, files, resumes, job-search criteria, preferences, messages, links, notes, feedback, company information, job information, or other materials (“User Content”).
You retain ownership of your User Content. By providing User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, process, analyze, transmit, display, modify, and create derivative works from User Content as necessary to provide, operate, maintain, secure, support, and improve the Service.
You represent and warrant that:
- You have all rights necessary to provide the User Content.
- Your User Content does not violate any law, contract, privacy right, intellectual-property right, or other third-party right.
- Your User Content does not contain malicious code, unlawful content, deceptive content, or content intended to harm others.
- Your User Content is not provided for the purpose of abusing, disrupting, reverse engineering, or unfairly exploiting the Service.
We may remove, restrict, or refuse User Content at our discretion if we believe it violates these Terms, applicable law, third-party rights, or the integrity of the Service.
9. Accounts and Security
Some features may require an account. You agree to provide accurate, current, and complete account information and to keep that information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must notify us promptly if you believe your account, credentials, connected accounts, or data have been compromised.
We may suspend or terminate accounts at our discretion, including if we believe an account has been used in violation of these Terms, presents a security risk, creates legal risk, or harms the Service, other users, employers, or third parties.
10. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms.
You agree not to:
- Violate any applicable law, regulation, contract, or third-party right.
- Use the Service for fraudulent, deceptive, abusive, harassing, discriminatory, or harmful purposes.
- Submit false, misleading, unlawful, infringing, or unauthorized content.
- Attempt to gain unauthorized access to the Service, related systems, user accounts, connected accounts, APIs, data, or infrastructure.
- Interfere with, disrupt, degrade, overload, or compromise the Service or its security.
- Introduce viruses, malware, harmful code, or other destructive materials.
- Reverse engineer, decompile, disassemble, or attempt to derive source code, models, systems, algorithms, scoring logic, ranking methods, or non-public functionality.
- Scrape, crawl, harvest, extract, copy, mirror, or bulk-download data from the Service except as expressly permitted by us in writing.
- Use bots, scripts, automation, or automated account creation without our written permission.
- Use the Service to build, train, benchmark, enrich, or operate a competing product, service, database, model, job board, job-matching system, or commercial dataset.
- Resell, sublicense, rent, lease, distribute, or commercialize access to the Service without our written permission.
- Remove, obscure, or alter proprietary notices, attribution, or branding.
- Use the Service in a way that violates the terms of any third-party site, employer site, applicant tracking system, email provider, or connected service.
We may monitor use of the Service to detect abuse, enforce these Terms, protect users, maintain service integrity, and comply with legal obligations.
11. Employers, Recruiters, and Business Users
If you post, submit, import, sponsor, claim, edit, or manage job listings, company profiles, hiring information, or employer-related content, you represent that you have the authority to do so.
You are responsible for ensuring that employer content is accurate, lawful, non-discriminatory, current, and compliant with applicable employment, labor, privacy, consumer-protection, advertising, pay-transparency, and anti-discrimination laws.
You may not post or promote jobs that are unlawful, deceptive, discriminatory, exploitative, unpaid where prohibited, misleading, unavailable, or unrelated to a genuine hiring opportunity.
We may remove, modify, reject, or restrict employer content at our discretion.
We do not guarantee candidate volume, candidate quality, applications, interviews, hires, revenue, conversions, or recruiting outcomes.
12. Payments, Subscriptions, and Trials
The Service may offer paid plans, subscriptions, premium features, usage-based pricing, trials, or other paid services.
By purchasing a paid service, you agree to pay all applicable fees, taxes, and charges presented at checkout or in the applicable order, plan, or subscription terms.
Unless otherwise stated at purchase:
- Fees are billed in advance.
- Fees are non-refundable.
- Subscriptions automatically renew until canceled.
- You are responsible for canceling before the renewal date if you do not want to be charged.
- Trial access may convert to a paid subscription if payment information was provided and cancellation is not completed before the trial ends.
- We may change pricing, plans, limits, or included features with notice as required by applicable law or as otherwise described at purchase.
You authorize us and our payment processors to charge your selected payment method for applicable fees.
If payment fails, we may suspend, limit, or terminate access to paid features.
13. Service Limits and Availability
We may impose limits on accounts, usage, storage, searches, crawls, alerts, jobs processed, emails processed, API calls, exports, or other Service features.
We may modify, suspend, degrade, restrict, or discontinue all or part of the Service at any time.
We do not guarantee that the Service will be uninterrupted, timely, secure, accurate, complete, or error-free.
14. Beta, Experimental, and Preview Features
We may offer beta, experimental, preview, early-access, or unreleased features. These features may be incomplete, unstable, inaccurate, or changed without notice.
You use beta features at your own risk. We may modify, limit, or discontinue beta features at any time.
15. Intellectual Property
The Service, including software, design, interfaces, workflows, databases, scoring methods, ranking systems, extraction methods, models, prompts, text, graphics, logos, trademarks, service marks, and other content, is owned by us or our licensors and is protected by intellectual-property and other laws.
Except for the limited right to use the Service under these Terms, no rights are granted to you in or to the Service or our intellectual property.
You may not use our name, logos, trademarks, branding, or confusingly similar marks without our prior written consent.
16. Feedback
If you provide suggestions, ideas, bug reports, feature requests, comments, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialize, and incorporate that feedback without restriction or compensation to you.
17. Privacy
Our collection and use of personal information is described in our Privacy Policy, available at /privacy/.
By using the Service, you acknowledge that we may collect, use, disclose, and otherwise process information as described in the Privacy Policy.
If you use connected-account features, including email-processing features, additional privacy terms or provider-specific disclosures may apply.
18. Copyright and DMCA Notices
If you believe content on the Service infringes your copyright, you may submit a notice to us at privacy@jobweb.io.
Your notice should include:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it.
- Your contact information.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
We may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate.
19. Data Sources and Public Information
The Service may reference or process publicly available information, third-party job postings, employer websites, career pages, applicant tracking systems, job boards, company websites, and other sources.
We do not claim ownership of third-party job postings, employer trademarks, company names, logos, or third-party materials displayed or referenced through the Service.
Company names, logos, trademarks, and job information are provided for identification, informational, or compatibility purposes only. Their appearance on the Service does not imply endorsement, sponsorship, partnership, approval, or affiliation unless expressly stated.
20. No Professional Advice
The Service does not provide legal, financial, tax, immigration, career, employment, recruiting, compensation, or professional advice.
Any job-search guidance, recommendations, scores, summaries, classifications, or alerts are informational only. You are responsible for making your own decisions and seeking professional advice where appropriate.
21. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, PRODUCE ANY PARTICULAR RESULT, IDENTIFY ANY PARTICULAR JOB, IMPROVE YOUR JOB SEARCH, LEAD TO INTERVIEWS OR OFFERS, BE UNINTERRUPTED, BE SECURE, BE ERROR-FREE, OR BE FREE FROM HARMFUL COMPONENTS.
WE DO NOT WARRANT THAT JOB LISTINGS, FITCHECK RESULTS, SCORES, RANKINGS, SUMMARIES, ALERTS, COMPENSATION INFORMATION, APPLICATION LINKS, EMPLOYER INFORMATION, OR THIRD-PARTY CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR AVAILABLE.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, EMPLOYMENT OPPORTUNITY, BUSINESS OPPORTUNITY, APPLICATION OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.
Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you.
23. Indemnification
You agree to defend, indemnify, and hold harmless JobWeb.io, its affiliates, officers, directors, employees, contractors, agents, licensors, vendors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use of the Service.
- Your violation of these Terms.
- Your User Content.
- Your violation of any law, regulation, contract, or third-party right.
- Your use of third-party sites, employer sites, applicant tracking systems, or connected accounts.
- Your employment, recruiting, job-search, hiring, or application-related activity.
24. Suspension and Termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate your access to the Service at any time if we believe:
- You violated these Terms.
- Your use creates legal, security, operational, reputational, or financial risk.
- Your account has been compromised or used without authorization.
- Your use harms users, employers, third parties, or the Service.
- We are required to do so by law, provider policy, court order, or government request.
Upon termination, your right to use the Service will immediately end. Sections that by their nature should survive termination will survive, including intellectual property, feedback, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law provisions.
25. Changes to the Service or Terms
We may update the Service and these Terms from time to time.
If we make material changes to these Terms, we will provide notice by posting the updated Terms on the Service or through other reasonable means. The updated Terms will become effective when posted unless a later effective date is stated.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
26. Export and Sanctions Compliance
You may not use the Service if you are located in, organized under the laws of, or ordinarily resident in a country or territory subject to applicable trade sanctions or embargoes, or if you are identified on a restricted-party list maintained by the United States or another applicable government authority.
You agree to comply with applicable export control and sanctions laws.
27. Governing Law
These Terms are governed by the laws of Washington State, without regard to its conflict-of-law principles.
28. Dispute Resolution
Before filing a claim, you agree to first contact us at privacy@jobweb.io and attempt to resolve the dispute informally.
If the dispute cannot be resolved informally, any legal action arising out of or related to these Terms or the Service will be brought in the state or federal courts located in Pierce County, WA, and you consent to the personal jurisdiction and venue of those courts.
29. Miscellaneous
These Terms, together with any additional terms referenced or presented with specific features, are the entire agreement between you and us regarding the Service.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce any provision is not a waiver of our right to do so later.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, sale of assets, corporate restructuring, or by operation of law.
